Modernisation of Justice System: Focus on efficiency and victims' rights

New Delhi, July 1 (IANS) India’s criminal justice system underwent a significant transformation with the implementation of three new laws — Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA).

These laws, which came into force on Monday, replaced the longstanding British-era statutes: the Indian Penal Code (IPC), Criminal Procedure Code (CrPC), and the Indian Evidence Act.

All across the country, new FIRs were registered under these modernised laws, marking a departure from the previous legal frameworks. However, cases filed before July 1 will continue under the old laws until they reach their final conclusion.

The journey towards these reforms began six months ago when the laws were enacted, following extensive consultations with key stakeholders such as Supreme Court judges, governors, civil servants, police officers, and lawmakers.

Union Home Minister Amit Shah played a pivotal role, conducting 158 meetings and incorporating around 3,200 suggestions into the drafting process.

The laws were scrutinised by a Parliamentary committee, with most recommendations being accepted before being presented to Parliament for approval. The consultation process took four years before enactment of the laws six months ago.

Key features of the new laws include:

Bharatiya Nyaya Sanhita (BNS) has been streamlined to 358 sections, down from 511 in the IPC, incorporating 21 new crimes, increased penalties for 82 offences, and introducing minimum punishments for 25 crimes.

Duration of imprisonment has been extended in 41 crimes.

Moreover, community service has been introduced as a penalty in six crimes. Around 19 sections have been removed.

Bharatiya Nagarik Suraksha Sanhita (BNSS) now comprises 531 sections, with modifications to 177 sections, including additions of nine new sections and 39 sub-sections, and deletions of 14 sections.

Bharatiya Sakshya Adhiniyam (BSA) replaces the Indian Evidence Act (166 sections) with 170 sections, making changes to 24 sections and adding two new sub-sections while removing six sections.

Earlier, Prime Minister Narendra Modi had articulated the ethos behind these reforms as “citizen first, dignity first, and justice first,” emphasising a shift from traditional policing methods (‘danda’) to modern data-driven approaches.

The new laws also prioritise swift justice for crimes against women and children, ensuring completion of investigations within two months of filing. Victims are entitled to regular updates on their cases within 90 days, and courts are empowered to limit adjournments to expedite proceedings.

In Parliament, Amit Shah underscored that the focus of these reforms is on enhancing justice delivery while safeguarding the rights of both victims and accused individuals, moving away from punitive measures alone.

The overhaul aims to rid the legal system of colonial-era vestiges and enable online reporting of crimes, allowing for more accessible and transparent law enforcement.

These legislative changes mark a significant step towards modernising India’s criminal justice system, aligning it with contemporary needs and global standards.

Champai Soren quits as Jharkhand CM, clears deck for Hemant Soren's reinstatement

Ranchi, July 3 (IANS) With the buzz over JMM President Hemant Soren returning as Jharkhand Chief Minister getting louder on Wednesday, his close aide Champai Soren resigned as the CM barely five months after taking oath.

Hemant Soren is presently out on bail in a money laundering case linked to an alleged land scam.

Champai Soren submitted his resignation to Governor C.P. Radhakrishnan at the Raj Bhavan on Wednesday, following which Jharkhand Mukti Morcha (JMM) supremo Hemant Soren handed over a Letter of Support to the Governor, staking claim to form the new government.

Congress’ Jharkhand in-charge Ghulam Ahmad Mir was also present along with the JMM leaders.

After handing over his resignation, Champai Soren said, “When the leadership had changed, I was given responsibility. You know the sequence of events. After Hemant Soren came back, we (the coalition partners) picked him as our leader. I have now resigned. I am following the decision taken by the coalition.”

Champai Soren was sworn in on February 2, just two days after two-time Chief Minister Hemant Soren was arrested by the Enforcement Directorate in connection with the land scam case.

Earlier on Wednesday during a meeting of the JMM-led coalition’s legislators and leaders at Hemant Soren’s residence here, Champai Soren offered to quit the Chief Minister and proposed Hemant Soren’s name, which was agreed to by those present at the meeting.

Ghulam Ahmad Mir, Jharkhand Congress President Rajesh Thakur, and prominent leaders of all JMM allies attended the meeting.

The political scenario in the state changed on June 28 when Hemant Soren secured bail from the Jharkhand High Court in the land scam case.

It was also decided at the meeting that the coalition will be led by Hemant Soren in the run-up to the Assembly polls scheduled in Jharkhand later this year.

Two held in Punjab for trafficking people to Cambodia

Chandigarh, July 3 (IANS) The Punjab Police’s Cyber Crime Division has arrested two travel agents for trafficking people from the state to Cambodia and other South East Asian countries, Director General of Police Gaurav Yadav said here on Wednesday.

The accused have been identified as Amarjeet Singh, owner of Visa Palace Immigration in Mohali, and his accomplice Gurjodh Singh.

As per information, the arrested travel agents were sending people from Punjab to Cambodia, promising them data entry jobs. On arrival at Siam Reap in Cambodia, their passports were taken away from them and they were forced or tortured to work in cyber scamming call centres to target people to commit financial fraud.

DGP Yadav said following the information from a victim, who managed to escape from Cambodia after getting in touch with the Indian Embassy, the state Cyber Crime Police Station had registered a first information report and started investigations in this case.

He said preliminary investigation has revealed that the accused have fraudulently sent many people to Cambodia and other South East Asian countries, where they are forcibly made to work at centres engaged in cyber scamming Indians.

The details of the people, who are in cyber slavery, are being obtained and contacts are being established with them and their families, he added.

Sharing details, ADGP (Cyber Crime) V. Neeraja said police teams led by Inspector Deepak Bhatia conducted a raid at the office of Visa Palace and arrested both the accused.

She said the accused have revealed that they were carrying on these illegal activities in connivance with other agents belonging to different states.

She exhorted the people to be aware of such fraudulent immigration activities and not fall prey to the fake promises of travel agents offering lucrative job opportunities abroad.

Meanwhile, the Ministry of External Affairs has set up an Overseas Workers Resource Centre as a single-window facilitation centre to provide support services to people desirous of going abroad for employment.

Kerala Education Minister irked by cabinet colleague's remark on academic standards

Thiruvananthapuram, July 3 (IANS) While Kerala’s ruling Left takes pride in the quality of education in the schools in the state, a cutting remark by Culture Minister Saji Cherian on the prevailing academic standards has left his cabinet colleague and Education Minister V. Sivankutty fuming and trying to control the damage.

With the new academic year just a few weeks old, Cherian, who is known for being outspoken – which saw him quitting as state minister a few years back over a remark on the Constitution before he was reinstated, left many, especially Sivankutty in a spot of bother, when he said many students who pass Class 10 examinations in the state do not even know to read or write. He further said that in the past to get the minimum pass mark of 210 marks in Class 10 public examinations was difficult, but now it’s all pass and any drop in the pass percentage is seen as a reflection of poor governance of the state government.

Cherian’s remark created ripples and a cornered Sivankutty on Wednesday took potshots at his colleague by citing his present illness.

“You all know Cherian as due to his remarks, he has run into trouble. So now he is down with fever, we will give him time to correct himself as what he said is not sure,” Sivankutty said.

A look into the 2024 SSLC Class 10 results, showed of the 4,26,892 students who appeared, 4,25,565 students became eligible for higher studies, with the pass percentage recording a high of 99.69 per cent. The pass percentage, about three to four decades back, was between 55 to 60 per cent.

Meanwhile, according to the grapevine, the dispute between the two ministers relates to their past differences as both rose from student organisations and while Sivankutty was the state chief, Cherian was a district leader and they had some issues then.

Amid heat on Rahul, 2012 video of Sonia Gandhi surfaces; both seen egging MPs to disrupt House

New Delhi, July 3 (IANS) Congress MP and Leader of Opposition (LoP) in Lok Sabha Rahul Gandhi stirred a hornet’s nest during the Prime Minister’s address in the House, as his persuasion of Congress and other Opposition MPs to disrupt the House was not only called out by Speaker Om Birla, but also the video of his objectionable act landed on social media, evoking strong criticism and reproval from the netizens.

The video, shared by BJP handles, showed the LoP egging on the fellow MPs to troop into the well of the House and engage in hooting and slogan-shouting with a motive to outshout the Prime Minister and disrupt his speech.

Their attempts to disrupt the PM’s speech, however, fell flat as PM Modi hauled them over the coals and showed mirrors on multiple issues.

However, Rahul’s attempt to disrupt the house proceedings seems not new for the Congress party.

Another video, pertaining to Sonia Gandhi, shows her using the same ‘tactics’ to drown out the rival faction.

The video, pertaining to 2012, shows Sonia Gandhi directing the party lawmakers to create disruptions in the House by making noises and raising slogans.

The two videos, put together, show Congress ‘affinity and culture’ for derailing and disrupting the House proceedings for its own interests, argue the observers.

This has also raised multiple questions for the grand old party – whether Congress does not believe in upholding democratic principles? Whether it has an underlying motive to undermine the Constitution? Whether it is a part of Congress strategy to disturb and destabilise the healthy democracy?

BJP spokesperson Shehzad Poonawala shared two videos on Wednesday, to show the contrast as to how the two parties — Congress and BJP — value the democracy.

In one video, Rahul Gandhi could be seen directing fellow MPs to jump into the well of the House and disrupt Prime Minister Narendra Modi’s reply to the Motion of Thanks to the President’s address.

Another video shared by the BJP spokesperson showed PM Modi offering a glass of water to the Opposition MPs who tried heckling his speech from the well of House.

Notably, LS Speaker Om Birla also admonished the LoP Rahul Gandhi for prompting Opposition MPs to engage in hooting and slogan-shouting and also gesturing them to move to the well of the House.

“This doesn’t behove the post you hold,” Om Birla had told Rahul, objecting to his gestures to the Opposition MPs.

School jobs case: Calcutta HC cautions Bengal govt for delaying nod to begin trial

Kolkata, July 3 (IANS) The Calcutta High Court on Wednesday expressed its ire over the indefinite delay by the West Bengal Chief Secretary in granting approval for initiating trial against state government employees named as accused in the multi-crore cash-for-school-jobs case.

The division bench of Justice Arijit Banerjee and Justice Apurba Sinha Ray said that although June 7 was the deadline for the Chief Secretary’s office to communicate to the court the time by when the approval will be given, the communication has not come yet though nearly a month has passed since then.

The bench noted that although the requisite approval has come from the office of West Bengal Governor C.V. Ananda Bose, formalities for beginning the trial could not be initiated as there has been no communication on this matter from the office of the Chief Secretary.

The bench on Wednesday set a deadline of three more weeks for the Chief Secretary to reply in the matter.

Noting that the court wants a quick reply in this matter, the bench said no further extension will be granted and necessary actions will follow in case of non-compliance.
